Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorarified Mandamus, to call for the impugned refusal check slip under Refusal No.RFL/Eraniel/130/2025 under Na.Ka.No.450/2025 passed by the respondent dated 01.08.2025 and to quash the same as illegal and further to direct the respondent to register the sale deed dated 31.07.2025 executed by the petitioner relating to the property situated under Subdivided new S.No.62/8B measuring to an extent of 5.500 cents 1/4

equivalent to 2.22 Ares situated at Mulagumoodu Revenue Village, Kalkulam Circle, Kanyakumari District.

ORDER

Heard both sides.

2.Sale deed date 31.07.2025 was was executed by the writ petitioner in favour of the second respondent herein. The document was presented for registration. The registration was refused by invoking Section 22-A of the Registration Act. Challenging the same, this writ petition has been filed.

3.When the matter was taken up for hearing, the purchaser through his counsel gives an undertaking that he will not develop the petition mentioned property for housing or any other kind of development without getting the approval of the competent authority. The said undertaking is recorded.

4.In view of the undertaking, the impugned refusal check slip is quashed and the writ petition is allowed. The parties are permitted to re-present the document. It shall be registered and released subject to fulfilment of other usual formalities. No costs. Consequently, connected miscellaneous petition is closed.
