Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorarified Mandamus, calling for the records of the 2nd respondent culminating in the impugned rejection letter dated 17.08.2023, quash the same as illegal and consequently direct the respondents to sanction and disburse the medical reimbursement of Rs. 68,781/- to the petitioner with applicable interest. 1/4

ORDER

This writ petition is filed challenging the impugned rejection letter dated 17.08.2023 issued by the 2nd respondent and seeking consequential direction to the respondents to sanction and disburse the medical reimbursement of Rs.68,781/- to the petitioner with applicable interest.

2. A perusal of the counter affidavit filed by the second respondent would indicate that even though the petitioner's claim had been repudiated pursuant to the New Health Insurance Scheme, it is also brought on record that the petitioner is also entitled to make a claim under the TamilNadu Medical Attendance Rues by making necessary application to the authorities concerned.

In view of the said specific statement made by the 2nd respondent, the petitioner herein is directed to make a claim as available under the TamilNadu Medial Attendance Rules, to the 3rd respondent herein and if any claim is made by the petitioner, the 3rd respondent herein is directed to forward the same to the appropriate authority and disburse the same within a period of eight weeks from the date of receipt of a copy of this order.

4. With the above directions, this writ petition is disposed of. There shall be no order as to costs.
