Respondents PRAYER :- Writ Petition, filed under Article 226 of the Constitution of India, praying this court to issue a Writ of Certiorarified Mandamus to call for the records connected with the impugned order in Letter No. S1 (1)/005161/2024-2 dated 30.07.2025 passed by the Respondent No.1 and quash the same, consequently direct the Respondent No. 1 to conduct fresh enquiry by complying the directions issued by this Honble Court in W.P(MD).No.15792/2025 in accordance with law within the time stipulated by this Court.

ORDER

This Writ Petition is filed to issue a Writ of Certiorarified Mandamus to call for the records connected with the impugned order in Letter No. S1 (1)/005161/2024-2 dated 30.07.2025 passed by the Respondent No.1 and quash the same, consequently direct the Respondent No. 1 to conduct fresh enquiry by complying the directions issued by this Honble Court in W.P(MD).No.15792/2025 in accordance with law within the time stipulated by this Court.

When the matter was taken up for hearing, learned Special Government Pleader placed on record the proceedings of the first respondent herein which would indicate that the petitioner who had been transferred earlier to the Regional Joint Commissioner Office of HR & CE, Madurai was cancelled and he had now been posted to the office of Executive Engineer Technical (Building and Maintenance) Circle, Madurai, as earlier transfer order has now been recalled. 3/6

In view of the submission, the order impugned herein would no more survive and hence there is no necessity to adjudicate the writ petition any further and accordingly the writ petition stands closed. However, there shall be a direction to the petitioner to join in the said post within a period of one week from the date of issuance of the posting order failing which, the proceedings impugned in this writ petition shall be continued against the petitioner. No costs. Consequently, connected miscellaneous petition stands closed.
