Respondents PRAYER:- Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus directing the respondents 1 to 6 to take immediate action to remove the encroachment of the cart track pathway which starts in S.No.811 and ends in S.No.346/2A for 136 meter, by the 7th respondent herein as per the proceedings already made by the 4th respondent in Oo.Mi.A2/22/2025 dated 22.07.2025 and also in Moo.Mu.A2/2003/2025 dated 08.09.2025 within the time as fixed by this Hon'ble Court.

ORDER
(Order of the Court was made by N.SATHISH KUMAR, J.) This Writ Petition has been filed seeking a direction to the respondents 1 to 6 to take immediate action to remove the encroachment 2/6
of the cart track pathway which starts in S.No.811 and ends in S.No. 346/2A for 136 meters, by the 7th respondent herein as per the proceedings already made by the 4th respondent in Oo.Mi.A2/22/2025 dated 22.07.2025 and also in Moo.Mu.A2/2003/2025 dated 08.09.2025 within the time as fixed by this Hon'ble Court.
2. According to the petitioner, the 7th respondent has encroached the cart track pathway in the subject property. In this regard, the petitioner has already sent representation on 22.09.2025 to take immediate action. However, no action has been taken by the respondents. Hence, the petitioner has filed this Writ Petition.
3. The learned Additional Government Pleader appearing for the respondents 1 to 6, by referring to the proceedings of the 4th respondent dated 07.03.2026 would submit that a notice under Section 7 of the Land Encroachment Act, 1905 has been issued against the 7th respondent. He would further submit that the copy of the FMB sketch given by the official respondents does not indicate any such cart track. 3/6
4. Be that as it may, it is for the 7th respondent to submit her reply to the notice issued under Section 7 of the Land Encroachment Act, 1905. If any such reply is filed, the authorities shall consider the case of the 7th respondent and pass orders on its own merits after giving an opportunity to the petitioner, 7th respondent and other interested parties.
5. With the above directions, this Writ Petition is disposed of. There shall be no order as to costs.
