O R D E R

By asserting that the FMB sketch specifies the areas of Survey Nos.72/1B2 and 72/1B3 erroneously and that the correct areas woud be 1 acre as regards Survey No.72/1B2 and 83 cents as regards Survey No. 72/1B3, the petitioner had submitted an application for rectification before the Tahsildar. By this writ petition, the petitioner seeks the early disposal thereof.

2. Learned Government Advocate, accepts notice on behalf of all the respondents. He submits that the appropriate authority to consider such request is the Revenue Divisional Officer. If an application is made to the Revenue Divisional officer, he submits that the same would be disposed of on merits within three months from the receipt thereof. 2/5

3. In view of the above submission, the Revenue Divisional Officer, Madurai Division, Madurai, is suo motu impleaded as the fourth respondent in this writ petition.

4. Accordingly, without making any observations on the merits, this writ petition is disposed of on the following terms: (i) the petitioner shall filed an application for rectification of the FMB scketch before the Revenue Divisional Officer within one week from the date of receipt of a copy of this order; (ii) within three months from the date of receipt thereof, the Revenue Divisional Officer is directed to consider and dispose of such application on merits after providing a reasonable opportunity to the petitioner and any other person who would be affected by such decision. There shall be no order as to costs.
