ORDER : The Court Made the following order :- The petitioner, who was arrested by the respondent police on 2/11/2013 for the alleged offence under Sections 147, 148, 294 (b) and 302 IPC in Crime No.266 of 2013 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that due to wordy quarrel, the petitioner along with other accused assaulted the defacto complainant. At that time, the deceased intervened in order to safeguard the defacto complainant. When the second and third accused caught hold of the deceased, the petitioner stabed the deceased with knife and caused death.

3. The learned counsel for the petitioner submits that coaccused were released on bail and anticipatory bail.

4. Learned Government Advocate(Crl. Side) has strongly objected to grant bail to the petitioner.

5. I have carefully considered the rival contentions put forward by either side and also perused the materials available on record.

6. Considering all these facts and also considering the fact that the petitioner is undergoing incarceration right from 1/11/2013 and also considering the fact that the other co-accused were granted bail and anticipatory bail, I am inclined to grant the relief of bail to the petitioner. Accordingly, the petitioner is directed to be released on bail on his executing a bond for a sum of Rs.10,000/- (Rupees ten thousand only) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate No.IV, Trichy, and on further condition that the petitioner shall appear before the respondent Police daily at 11.00 a.m., until further orders. sd/- 30/12/2013 / TRUE COPY / Sub-Assistant Registrar (C.S.)
