ORDER : The Court Made the following order :- The petitioner / A2 apprehending arrest at the hands of the respondent police for the alleged commission of offences under Sections 376 and 506 (ii) of IPC., and Sections 4,6 and 7 of Protection of Children from Sexual Offences Act, 2012, in Crime No.28 of 2013, seeks anticipatory bail.

2. The case of the prosecution is that the first accused by name Selvan had committed an offence of rape on a minor girl. Thereafter, the parents of the victim have approached the Doctor for abortion and it is alleged that the Doctor had performed surgery resulting in miscarriage.

3. The learned counsel appearing for the petitioner would submit that the petitioner is nothing todo with the alleged commission of offence and he has been falsely implicated in this case.

4. The learned Government Advocate (crl.side) would submit that the petitioner herein is the Doctor, who has been charged along with another person as second accused in this case and the investigation is pending.

5. This Court, taking into consideration of the above said facts and circumstances, is inclined to enlarge the petitioner on anticipatory bail. Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on his appearance before the learned Judicial Magistrate No.V, Tirunelveli and on executing a bond for a sum of Rs.10,000/- (Rupees ten thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioner shall appear before the respondent daily, as and when required. 6.
