PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus directing the respondents, particularly the 2nd Respondent for the subdivision of Survey Nos.8/1A and 10/1, situated at Warapur Village, Singampunari Taluk, Sivaganga District and issue a individual patta in favour of my name based on the registered Sale Deed No.1332 of 2025 dated 22.03.2025.

ORDER

By relying on sale deeds dated 06.02.1962 and 22.03.2025, the petitioner had applied for subdivision and separate patta in respect of S.Nos.8/1A and 10/1A. The present writ petition relates thereto. 2.Learned Government Advocate accepts notice for both the respondents. On pursual of patta No.1338, it is evident that the said patta stands in the name of 7 persons. Patta No.1302 in respect of S.No.10/1A stands in the name of Muthu Singaram Chettiar. Therefore, before taking a decision on the petitioner's request, notice should be issued to all the pattadhars in patta Nos.1338 and 1302.

3.In view of the above said facts, this writ petition is disposed of by directing the second respondent to conduct an enquiry on the petitioner's request for subdivision by issuing notice to all the pattadhars in patta Nos.1338 and 1302 and after providing a reasonable opportunity to the said parties and the petitioner, a speaking order shall be issued within three months from the date of receipt of a copy of this order.
