ORDER

The petitioner seeks to quash the impugned charge sheet in C.C. No. 506 of 2022 pending on the file of the learned Judicial Magistrate, Radhapuram, Tirunelveli District , which was filed for the offences under Sections 147 and 323 of IPC.

2.When this Court expressed that the points raised by the learned counsel for the petitioners are factual in nature, the learned counsel for the petitioner sought permission to withdraw this criminal original petition and has made an endorsement to that effect. However, the learned counsel for the petitioner would submit that the petitioners has now completed his law degree and that unless his appearance is dispensed with, he would be put to undue hardships.

3. In view of the above submission, this Criminal Original Petition is dismissed as withdrawn. The personal appearance of the petitioner before the Trial Court is dispensed with on all hearing dates (provided he 2/4

is represented by a lawyer) unless his personal appearance is required by the learned Magistrate for the progress of the trial. Consequently, connected miscellaneous is closed.
