PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Certiorarified Mandamus calling for the records in respect of order dated 15th March 2025 of the 1st respondent passed in file number TR1077362103725 and quash the same and direct the 1st respondent to re-issue a fresh pass port in lieu of a damaged one based on the petitioner's application in TR1077362103725 (Application Reference No.25-1001228927) dated 31st January 2025.

ORDER

The present writ petition has been filed seeking a mandamus as against the first respondent for reissuance of the passport based upon of the request of the petitioner dated 31.01.2025.

2. The learned Government Advocate(crl.side) appearing for the second respondent brought to the notice of the Court that an FIR is pending in Cr.No. 241 of 2021 on the file of the Irumbulikurichi Police Station, Ariyalur District as against the writ petitioner. The investigation is pending. So far, charge sheet has not been laid.

3. So far as, another criminal case as against the writ petitioner is concerned, he was acquitted by the learned District Munsif cum Judicial Magistrate Court, Sendurai, on 26.06.2025 in S.T.C.No.352 of 2024. 2/4

4. This Court in a judgment reported in 2014 (8) MLJ 61 has held that mere pendency of FIR is not a legal impediment for issuance of passport.

5. Considering the above said facts, the first respondent is directed to the consider the request of the petitioner for reissuance of passport and pass orders within a period of four weeks from the date of receipt of a copy of this order.
