ORDER : The Court Made the following order :- The petitioner, who was arrested by the respondent police on 5/11/2013 for the alleged offence under Section 302 IPC altrered into Sections 341 and 302 IPC in Crime No.380 of 2013 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that one Santhi, W/o. Ram, lodged a complaint with the respondent/complainant that the petitioner/accused assaulted the deceased Kalidoss, son of the defacto complainant on 2/11/2013 due to previous enmity and he was succumbed to the injuries.

3. The learned counsel for the petitioner submits that the respondent had completed the investigation and filed the final report before the learned Judicial Magistrate, Pudukottai and the learned Judicial Magistrate has taken the same in P.R.C.No.29 of 2013 on 20/12/2013.

4. Learned Government Advocate(Crl. Side) has strongly objected to grant bail to the petitioner.

5. I have carefully considered the rival contentions put forward by either side and also perused the materials available on record. https://hcservices.ecourts.gov.in/hcservices/

6. Considering all these facts and also considering the fact, I am inclined to grant the relief of bail to the petitioner. Accordingly, the petitioner is directed to be released on bail on his executing a bond for a sum of Rs.10,000/- (Rupees ten thousand only) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate, Pudukottai and on further condition that the petitioner shall appear before the Committal Court daily at 11.00 a.m., until further orders. sd/- 30/12/2013 / TRUE COPY / Sub-Assistant Registrar (C.S.)
