PRAYER : Criminal Miscellaneous Petition filed under Section 430(1) of BNSS, to suspend the sentence imposed on the petitioners / appellants/ accused Nos.1 and 2 passed by the Special Court for Trial of SC/ST (POA) Act Cases, Virudhunagar District at Srivilliputhur in SplSC.No.37 of 2022 dated 01.09.2025 and enlarge the petitioners on bail pending disposal of the criminal appeal. ORDER

The petitioners are accused Nos.1 and 2 in Spl.S.C.No.37 of 2022 on the file of the Special Court for Trial of SC/ST (POA) Act Cases, Virudhunagar District at Srivilliputhur. By judgment dated 01.09.2025 the petitioners have been found guilty, convicted and sentenced as under: Section Punishment Fine (in Rs) default class A1 324 IPC and 3(2) (va) of SC/ST (POA) Act One year rigorous imprisonment 1,000/- One month simple imprisonment A2 323 IPC and 3(2) (va) of SC/ST (POA) Act Six months rigorous imprisonment one month simple imprisonment Challenging the above said conviction and sentence, the petitioners have preferred CrlA(MD)No.1041 of 2025 along with this petition seeking suspension of sentence. The appeal has been admitted by this court on 26.09.2025.

2.This court while entertaining this petition has granted interim suspension of sentence till 13.10.2025 with certain conditions and directed the Registry to list the matter on 13.10.2025. However thereafter this petition has not been listed and the petitioners have not taken any 2/4

steps either for obtaining extension of the interim suspension or surrendering before the respondent police. Therefore, this court is not inclined to entertain this petition. Accordingly, this petition is dismissed with liberty to the petitioners to surrender before the respondent police and renew the application. The respondent police shall secure the petitioners forthwith.
