Mr.M.Sakthi Kumar, (for R1) Government Advocate (Criminal Side) Mr.Ananth C.Rajesh (for R2) ORDER : The Court made the following order :- This Criminal Miscellaneous Petition has been filed seeking modification of the condition imposed in paragraph No.8(c) of the order passed by this Court in Crl.R.C.(MD) No.644 of 2025, dated 07.07.2025.

2. The learned counsel appearing for the petitioner submitted that the petitioner is the owner of the JCB bearing Registration No.TN 46 M 3901. He further submitted that the petitioner is unable to comply with the above condition, as the original Registration Certificate is in the custody of Shriram Finance Private Limited, Aranthangi - 614 616. It was contended that when the matter came up on 11.12.2025, the 2/5

petitioner sought modification of the said condition on the ground that the original RC book had been deposited with the said Finance Company, and a letter purportedly issued by the Finance Company acknowledging the same was also produced.

3. However, Mr.C.Ananth C.Rajesh, learned counsel appearing for the second respondent, categorically contended that the second respondent had never issued any such acknowledgement. In view of the said contention, this Court directed the Manager of the said Finance Company to appear before the Court. Accordingly, today, Mr.Neethikesan, who claimed to be the Branch Manager of the said Finance Company, appeared before this Court and submitted that no such acknowledgement had been issued by the Finance Company.

4. In view of the above, this Court is not inclined to entertain this Criminal Miscellaneous Petition and the same stands dismissed.

5. The petitioner is directed to deposit a sum of Rs.1,000/- (Rupees One Thousand only) towards establishing an E-Library, to the credit of 3/5

the MBHAA, in Indian Bank, Madurai Bench of Madras High Court Branch, Account No.496038755, IFSC Code: IDIB000H040, MICR Code: 625019020, within a period of one week from the date of receipt of a copy of this order.
