Respondents PRAYER : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the respondents to pay interest at the rate of 12% per annum, for the period of delay from the petitioner's husband's date of last service (30.09.2020) to till the date of reimbursement (27.09.2023) of amount paid towards her husband's terminal and pension benefits, namely EPF Employee's Contribution, Grautity, Encahsment of Earned/Sick Leaves and commuted value of pension and other monetary benefits etc., within a time frame as may be fixed by this Court, without affecting the petitioner's right to claim balance amounts towards those benefits. 1/4

ORDER

The present writ petition has been filed by a wife of an employee of the respondent Corporation, who had voluntarily retired from service on 30.09.2020.

2. According to the writ petitioner, her husband had passed away on 22.09.2022 and his terminal benefits were released only on 27.09.2023. Hence, she has made a representation on 20.11.2023 seeking interest for the belated disbursement of the terminal benefits. Since the same has not been considered, the present writ petition has been filed.

3. Considering the above said facts, the respondents herein are directed to pay interest at the rate of 6% from the due date till 26.09.2023 within a period of twelve (12) weeks from the date of receipt of copy of this order.

4. With the above said observations, this Writ Petition stands disposed of. No costs.
