PRAYER :- For Bail in Crime No.314 of 2023 on the file of the Respondent Police. ORDER : The Court made the following order :- The petitioner, who was arrested and remanded to judicial custody on 20.10.2023 for the alleged offence punishable under Section 379 IPC in Crime No.314 of 2023, on the file of the respondent police, seeks bail. 2.The case of the prosecution is that on 06.10.2023, at about 11.00 am., the defacto complainant withdrawn a sum of Rs.14 Lakhs from his bank account and the same was kept inside of the petrol tank cover of his two wheeler. Thereafter, he went 1/3

to fruit market and he found that the amount kept inside the petrol tank cover was stolen. Hence the case.

3.The learned counsel appearing for the petitioner would contend that the petitioner is innocent and he has not committed any offence as alleged by the prosecution. He would further submit that the petitioner is in custody from 20.10.2023, hence he seeks bail.

4.The learned Additional Public Prosecutor appearing for the respondent Police would submit that the amount was recovered from the petitioner herein. He would further submit that the investigation was completed and charge sheet also filed, which was taken on file in C.C.No.2294 of 2023 by the learned Judicial Magistrate No.III, Tirunelveli. That apart, P.W.1 to P.W.6 were examined. Therefore, he opposed to grant bail to the petitioner.

5.Heard both sides and perused the materials available on record. 6.Considering the seriousness of the offence committed by the petitioner, this criminal original petition is dismissed.
