ORDER

The writ petition is filed for a mandamus to direct the respondent to conduct the enquiry on the petitioner's complaint dated 07.03.2024 and stop all further illegal sale of transfer of property belonging to Our Lady of Lourdes Church, Alanvilai, Kanyakumari District.

2. From the very prayer sought for in the writ petition, it is seen that that the allegation of the petitioner is that the private respondent is illegally attempting to sell the Church property. If that be so, the prayer sought for in the writ petition cannot be entertained. The petitioner has to approach the competent Civil Court for appropriate relief. It is further stated that the petitioner has already approached the Civil Court in this regard. Therefore, the remedy available to the petitioner is only in the said Civil Court.

3. Accordingly, the writ petition is disposed of with liberty to the petitioner to approach the said Civil Court. No costs. Consequently, connected miscellaneous petition is closed.
