O R D E R

This writ petition has been filed seeking issuance of a writ of mandamus, directing the second respondent to conduct survey and earmark the petitioner's land in S.Nos.68/16A and 16C total extent of 0.7.66 Ares at kaluneerkulam Village, Alankulam Taluk, Tenkasi District within the time frame.

2. Heard the learned counsel for the parties and perused the materials available on record.

3. The learned counsel appearing for the petitioner submits that the representation dated 26.05.2025 was made seeking survey and demarcation of the boundaries of the property in question. Since no action has been taken by the respondents 1 and 2, the present writ petition has been filed.

4. Per contra, learned counsel appearing for the respondents 7 to 11 submitted that already a partition suit is pending between the petitioner and the respondents 4 to 11 and therefore, the petitioner has to seek his remedy before the civil Court.

On the other hand, the learned Special Government Pleader, appearing on behalf of respondents 1 and 2 submits that after considering the claims of all parties, proper steps would be taken to survey and demarcate the land in accordance with Sections 9 and 10 of the Tamil Nadu Land Survey and Boundaries Act, 1923.

6. In view of the above, this Court directs the first respondent to consider and dispose of the petitioner's representation dated 26.05.2025 after taking into account the pending civil litigation, if any. Notice shall 3/6

be issued to the petitioner, respondents 4 to 11 and the owners of relevant adjacent lands and appropriate orders shall be passed in accordance with Sections 9 and 10 of the Tamil Nadu Land Survey and Boundaries Act 1923, within a period of twelve weeks from the date of receipt of a copy of this order. The objections shall be recorded and will form part of the record. In the event of any rival claims, the same can be agitated before the competent civil court. No costs.
