ORDER

Heard the learned counsel for the petitioner and the learned Government Advocate for the respondents 1 and 2. The third respondent has been served and his name is also printed in the cause list and he has not chosen to oppose the writ prayer. 2.The third respondent got married to one Vijayalakshmi. Through the wedlock, minor Kanishka was born. Vijayalakshmi has since passed away. The third respondent is said to be suffering from some terminal illness. The authorities have confirmed that the minor child is with the petitioner who is none other than the maternal aunt. The petitioner in her affidavit states that she is bringing up the minor child Kanishka. It is stated that the third respondent had also filed GWOP No.22 of 2022 on the file of the Principal District Judge, Thoothukudi seeking custody of the child. The GWOP was dismissed for default on 18.09.2024.

3.From this, one can come to a safe conclusion that the respondent is not interested in maintaining the child. In such matters, the interest of the child alone is paramount. I, therefore, direct the 2/4

3 WP(MD)No.27044 of 2025 second respondent to delete the name of the minor child from the family ration card of the third respondent and include her name in the family ration card of the petitioner herein. The minor child can very well be shown as the foster child of the petitioner herein. 4.This writ petition is allowed. No costs.
