PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the first respondent to re-issue passport to the petitioner by considering the petitioner's application vide reference File No.MD1075531325725 and the petitioner's representation dated 17.09.2025 within the time limit fixed by this Court. The present Writ Petition has been filed seeking a Mandamus as against the first respondent for issuance of passport based upon the petitioner's application dated 17.09.2025.
2. According to the learned counsel appearing for the writ petitioner, when the petitioner had landed in Chennai International Airport, the customs Officer received his passport and checked his belongings and thereafter, during customs verification the officials have misplaced his passport. Therefore, he has also lodged a complaint for missing of the passport. Hence, he has made an application seeking renewal of passport. The police officials on verification informed him that a criminal case is pending as against him. 2/5

The learned Government Advocate (Crl.side) appearing for the second respondent pointed out that a criminal case was pending as against the writ petitioner in C.C.No.261 of 2024 on the file of the District Munsif cum Judicial Magistrate, Tiruppuvanam and the same has been quashed by the dedicated bench of this Court.
4. In view of the above said facts, the first respondent is directed to consider the application of the petitioner for re-issuance of passport within a period of four weeks from the date of receipt of a copy of this order.
5. With the above said observation, this Writ Petition stands disposed of. There shall be no order as to costs.
