ORDER

This Criminal Original Petition is filed to transfer the investigation in the case in Crime No.157/2023 from 3rd respondent to 2nd respondent or any other independent investigating agency.

2. The grievance of the petitioner is that the petitioner is running a coir business and having a godown. The 1 to 5 accused persons were committed theft of the valuable things from the godown, worth about Rs.2,00,000/-. Hence a complaint was made before the third respondent and a case in Crime No.157 of 2023 was filed. Since no action was taken by the third respondent and no recovery was made, this petition came to be filed seeking transfer of investigation.

3. Learned Additional Public Prosecutor submitted that it is an issue between the same family members and the sixth accused in this 2/4

case is stated to be the daughter of the petitioner and the first accused is the son in law of the petitioner.

4. It is seen that against the own family members, a complaint has been filed. The parties have to settle the issue among themselves. Absolutely, there is no reason to entertain this petition.

5. Accordingly, this Criminal Original Petition is dismissed. 07.12.2023 NCC :
