O R D E R

This writ petition has been filed for a writ of Certiorarified Mandamus, to call for the records pertaining to the impugned order issued by the first respondent in No.29683/K2/2020 dated 01.09.2025 and quash the same and consequently direct the respondents to provide the compassionate appointment to the petitioner on account of his mother Yogamalar.

A perusal of the report submitted by the Thasildar with regard to the circumstances of the family of the deceased employee shows that the family's annual income is Rs.4,32,000/- and that property to a value of Rs.20,24,000/- stands in the name of the deceased employee and that the deceased employee had also benefited with terminal benefits.

It is to be noted that the Division Bench of this Court in W.P(MD)No.5 of 2024, has categorically held that an application for compassionate appointment should not be rejected merely on the ground that the family of the Government Servant has received the benefits under various family welfare scheme and that while considering such a request for compassionate appointment, an objective assessment of the 2/5

financial condition of the family should be made, taking into account its assets and liabilities including the persons of earning members, ages of the children and the essential needs of the family etc.

4. In such view of the matter, the reasons assigned by the respondents for rejecting the petitioner's claim for compassionate appointment cannot hold good and therefore, the impugned order is liable to be interfered with.

For the aforesaid reasons, the impugned order is set aside and the claim of the petitioner is remitted back to the respondents to consider the claim as per the scheme envisaged for compassionate appointment and pass appropriate orders within a period of 12 weeks from the date of receipt of a copy of this order.

6. In fine, the writ petition stands allowed. There shall be no order as to costs.
