PRAYER :- For Anticipatory Bail in Cr.No.219 of 2025 on the file of the respondent police.

ORDER: The Court made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 191(2), 296(b), 115(2), 324(4) & 351(3) of BNS Act, 2023, in Crime No.219 of 2025, on the file of the respondent police, seeks anticipatory bail.

2.The case of the prosecution is that on 11.09.2025, the petitioners and others in an inoxicated state, arrived at a residence seeking a room. When denied, due to no vacancies, they became aggressive, verbally abused the manager, damaged the front glass and surveillance camera and also stolen a hard disk valued at Rs.40,000/-. Hence, this case. 3.The learned counsel appearing for the petitioners submitted that the petitioners have been falsely implicated in this case and they have not committed any offence. He seeks this Court to grant anticipatory bail to the petitioner.

4.The learned Government Advocate (Crl. side) appearing for the respondent submitted that the offences committed by the petitioners are serious in nature.

5.This Court already granted interim bail to the petitioners with the conditions to handover the Hard Disk to the respondent police. The respondent police has filed a status report wherein it has been stated that the petitioners have handed over the Hard Disk and the same has been sent to the Regional Forensic Sciences Laboratory in order retrieve the deleted contents, if any. Hence, the condition to hand over the Hard Disk has been complied with by the petitioners. Accordingly, this Court is inclined to grant anticipatory bail to the petitioners with certain conditions. However, since the defacto complainant is having a life threat, the petitioner is directed to stay in Virudhachalam until further orders.

6.Accordingly, the petitioners are6 ordered to be released on bail in the event of arrest or on their appearance, on condition that the petitioners shall execute a bond for a sum of Rs.10,000/-(Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the Judicial Magistrate No.I, Pudukkottai, within a period of fifteen days from the date of receipt of a copy 3/6

of this order and on further conditions that: [a]the petitioners and the sureties shall affix their photographs and left thumb impression in the surety bond and the Magistrate may obtain a copy of their Aadhaar card or bank pass book to ensure their identity. [b]the petitioners shall stay in Virudhachalam and report before the Virudhachalam Town Police Station, Cuddalore district, daily at 10.30 a.m., for interrogation until further orders.

[c]the petitioners shall not tamper with the evidence or witness either during investigation or trial.

[d]the petitioners shall not abscond either during investigation or trial. [e]On breach of any of the aforesaid conditions, the learned Magistrate/Trial Court is entitled to take appropriate action against the petitioners in accordance with law as if the conditions have been imposed and the petitioners are released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)AIR SCW 5560].

[f]If the accused thereafter abscond, a fresh FIR can be registered under Section 269 of BNS.
