Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the respondents 1 to 3 to consider the representation sent by the petitioner dated on 11.09.2023.

ORDER

Heard the learned counsel appearing for the writ petitioner and the learned Additional Government Pleader appearing for the official respondents. Considering the nature of order to be passed, issuance of notice to the private respondents is dispensed with. 2.The petitioner had earlier filed W.P.No.22703 of 2022. The issue travelled to the Hon'ble Division Bench in W.A.No.2226 of 2023. The Hon'ble First Bench disposed of the writ appeal on 25.08.2023 in the following terms:

"3.Learned State Government Pleader submits that the representation of the appellant is sent to the Central Valuation Committee and the same is pending with the said Committee.

4.It appears that the appellant has invited the order from this court. Moreover, the case ought not to have been filed at the Principal Seat, as the property is situated in Madurai.

5.Be that as it may, as it is submitted that the application/representation of the appellant with regard to the classification is pending with the Central Valuation Committee, the Committee may take a decision upon it, on its own merits, expeditiously, without being influenced by the orders passed by this court. The further grievance, if any, can only be entertained at the Madurai Bench." Taking advantage of the observations made by the Hon'ble First Bench, the present writ petition has been filed.

3.There is nothing to be adjudicated at this stage. The learned Additional Government Pleader categorically states that the Central Valuation Commission is presently seized of the matter. The said committee is directed to dispose of the mater on merits and in accordance 3/6

with law within a period of twelve weeks from the date of receipt of a copy of this order. The grievance of the petitioner is that valuation has been done on acreage basis and not done on square foot basis. That issue will be decided one way or the other by the Central Valuation Commission with the aforesaid time limit. I make it clear that I have not gone into the merits of the matter.

4.This writ petition is disposed of accordingly. There shall be no order as to costs.
