Respondents PRAYER: Petition filed under Article 226 of the Constitution of India, to issue a writ of mandamus directing the respondents herein to take necessary action as against the encroachers who erected shops/stalls and further to prevent polluting of surroundings of the holy tank belonging to the Malaikottai temple, Tiruchirapalli and to protect its sanctity and to prevent the public from hindrance of traffic congestion on the basis of considering the petitioner's representation dated 01.09.2025 within a stipulated time that may be fixed by this Court. [Order of the Court was made by The Hon'ble CHIEF JUSTICE] Heard.

2. Though an allegation has been made through this PIL with regard to the encroachment in and around the Malaikottai Temple, learned Additional Advocate General appearing for the second respondent brings to the notice of this Court that a petition has already been entertained by this Court and registered as W.P.(MD) No.13745 of 2023. In that view of the matter, we are not inclined to open another petition on the same issue.

3. This petition is disposed of, however, with liberty to the petitioner to intervene in the pending writ petition. There shall be no order as to costs.
