PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.462 of 2023 on the file of the Respondent Police.

ORDER : The Court made the following order :- The petitioners, who apprehend arrest at the hands of the respondent police for 1/3

the offences punishable under Sections 420 and 406 IPC in Crime No.462 of 2023, seek anticipatory bail.

2.The case of the prosecution is that the defacto complainant is running a Flex material whole sale company and he is a whole sale dealer. The wife of the defacto complainant is the owner of the company. The petitioners were working in the above said company form March 2022 to January 2023. The petitioners were doing some fraudulent activities in the said company in the information slip. Thereafter, they have stopped their job. Under these circumstances, a sum of Rs.9,80,000/- was debited from the bank account of the company and he came to know that the petitioners have misappropriated the cheques, which was already handed over by the defacto complainant. Hence the case.

3.The learned counsel appearing for the petitioners would submit that the petitioners are innocent persons and they have not committed any offence as alleged by the prosecution. Hence, he seeks anticipatory bail. 4.The learned Additional Public Prosecutor appearing for the respondent police would submit that the investigation in this case was completed and charge sheet also filed.

5.Considering the seriousness of the offence committed by the petitioners, this 2/3

Court is not inclined to grant anticipatory bail to the petitioners. Accordingly, this criminal original petition is dismissed.
