Prayer: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus to direct the 1st respondents herein to consider the petitioner's objections by way of representation dated 08.09.2025 and ensure that no licence is granted for running any cracker business in the petitioner's premises situated at S.No. 940 situated at Periya Kadai Veedhi, Trichy.

ORDER
This writ petition has been filed seeking issuance of a Writ of Mandamus to direct the 1st respondents herein to consider the petitioner's objections by way of representation dated 08.09.2025 and ensure that no licence is granted for running any cracker business in the petitioner's premises situated at S.No.940 situated at Periya Kadai Veedhi, Trichy.
2. Ms.D.Farjana, Ghoushia, learned Special Government Pleader, takes notice for the respondents 1 and 2. Mr.S.Prakash, learned Government Advocate (criminal side) takes notice for the respondents 3 to 6. Since no adverse order is going to be passed, notice to the 7th respondent is dispensed with. By consent, this writ petition is taken up for final disposal at the admission stage itself.

3. According to the petitioner, she is the owner of the property in question consisting of three shops, which were rented out to one Periyasamy, the father of the 7th respondent. At present, the sixth respondent is running a cracker shop in the said property, which is situated in a busy public area. Hence, the petitioner made several requests to the 7th respondent to desist from doing so. However, no heed was paid to the same. Consequently, the petitioner submitted a detailed objection by way of a representation to the official respondents on 08.09.2025. Since the said representation has not been considered, she has filed the present writ petition.
4. The learned Special Government Pleader and the learned Government Advocate (Crl. Side), appearing for the official respondents would submit that the objection of the petitioner will be considered in accordance with law.

In view of the above, without expressing any opinion on the merits of the matter, the official respondents are directed to consider the objection of the petitioner dated 08.09.2025 at the time of issuing the licence to the seventh respondent to run the firecracker shop, and to pass final orders on its own merits, after conducting an enquiry and affording a reasonable opportunity to both the petitioner and the seventh respondent. 3/5
6. With the above directions, this writ petition stands allowed. No costs.
