Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the respondents to pay the rate of 18% per annum for the belated payment of retirement benefits including Gratuity, Provident Fund, Leave Encashment Amount and Commutation within the time limit that may be fixed by this Court. ORDER

The present writ petition has been filed by a Helper of the respondent Transport Corporation, who attained superannuation on 31.08.2018.

2. According to the learned Counsel appearing for the petitioner, the petitioner's terminal benefits were released only on 20.09.2019. The petitioner has sent a representation on 20.10.2023 seeking disbursement of interest for the belated payment of the terminal benefits. Since there is no response, the present writ petition has been filed.

3. Considering the above said facts, the respondents 2 to 4 are directed to pay interest at the rate of 6% from the due date till the amount that was actually paid to the petitioner within a period of twelve (12) weeks from the date of receipt of a copy of this order.

4. With the above said direction, this writ petition stands disposed of. There shall be no order as to costs.
