Respondents PRAYER :- Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus directing the respondents to promote the petitioner as PG Assistant in Economics in the 6th respondent school namely, Sri Kanthimathi Ambal Girls Higher Secondary School, Palayamkottai, Tirunelveli as per Rule 28(2) (a) of the Tamil nadu Private Schools (Regulation) Rules, 2023 considering the fact that the petitioner is discharging her duties as PG Assistant in Economics since 16.09.2022.

ORDER

This Writ Petition is filed to issue a Writ of Mandamus directing the respondents to promote the petitioner as PG Assistant in Economics in the 6th respondent school namely, Sri Kanthimathi Ambal Girls Higher Secondary School, Palayamkottai, Tirunelveli as per Rule 28(2) (a) of the Tamil Nadu Private Schools (Regulation) Rules, 2023 considering the fact that the petitioner is discharging her duties as PG Assistant in Economics since 16.09.2022.

2. Learned Standing counsel appearing for the sixth respondent would submit that there is available vacancy in the PG Assistant (Economics) and from the eligible candidates working as BT Assistant in the same school, selection process will be carried on and the meritorious candidates will be appointed as per the Rules.

3. Recording the said submission, this writ petition is disposed of with a direction to the sixth respondent to complete the selection process for the promotion to the post of PG Assistant Economics within a period of three moths from the date of receipt of a copy of this order. 3/6

4. However, learned sixth respondent would submit that the said promotion would be subject to the prior approval granted by the educational authorities.

5. Since it is a promotion in the sanctioned post that is already available and sanctioned, as per grant-in-aid Code, no approval is necessary. No costs. Consequently, connected miscellaneous petition stands closed.
