Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the Respondents to provide the Petitioner suitable alternative employment (Light duty) in the Papanasam Branch of Tamil Nadu State Transport Corporation (Tirunelveli) Ltd., Tirunelveli, with pay protection and consider the Petitioner's 1/4

representation dated 20.8.2025 and pass such further or other orders as this Honble Court may deem fit and proper in the circumstances of the case and thus render justice.

ORDER

This writ petition is filed seeking direction to the Respondents to provide the Petitioner suitable alternative employment (Light duty) in the Papanasam Branch of Tamil Nadu State Transport Corporation (Tirunelveli) Ltd., Tirunelveli, with pay protection and consider the Petitioner's representation dated 20.8.2025.

2. I have carefully considered the submissions made on either side and perused the materials available on record.

3. Earlier the medical board has suggested for review after three years and even though the petitioner had been advised to appear before the medical board by the respondent, but, he had not appeared. 2/4

4. In view of the same, the 2nd respondent is directed to refer the petitioner to medical board, on such reference, the petitioner shall appear before the medical board and based upon the report of the medical board, further action can be taken to allot work to the petitioner. Since the petitioner's driving license has been cancelled at the request of the respondent Corporation, on the report of the medical board, except the post of driver, the petitioner can be accommodated to any other post. The said exercise shall be completed within a period of two weeks from the date of receipt of a copy of this order.

5. This writ petition is disposed of with the above direction. No costs. Consequently, connected miscellaneous petition is closed. 20.11.2025 Index : Yes/No Speaking/Non-Speaking order gvn 3/4
