PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Certiorarified Mandamus to call for the records pertaining to the impugned notice dated 20.09.2025 issued by the 2nd respondent fixing survey in respect of the land comprised in Survey No.143/1, Palapathira Ramapuram Village, Tenkasi District, and to quash the same as illegal, consequently, directing the 1st respondent to conduct an enquiry on the representation dated 03.07.2025 submitted by the petitioner's cousin, in terms of the proceedings of the District Collector, Tenkasi District dated 06.07.2025. 1/4

ORDER

A notice dated 20.09.2025 is challenged in this writ petition on the ground that the said notice is contrary to the order dated 05.08.2025 in W.P(MD)No.21347 of 2025 directing that an inquiry be conducted. 2.Learned Additional Government Pleader accepts notice on behalf of respondents 1 and 2. He has placed on record a subsequent notice scheduling an inquiry today in relation to the request of the private respondents for a survey. He also submits that the petitioner's objections would be considered and a speaking order would be issued in respect thereof. 3.In view of the above submissions of learned Additional Government Pleader, the apprehensions of the petitioner stand allayed. Therefore, this writ petition is disposed of by directing the first and second respondents to consider the petitioner's objections by conducting an inquiry and to issue a speaking order within two months from the date of receipt of a copy of this order. inquiry scheduled today shall be deferred so as to provide a reasonable opportunity to the petitioner to raise objections. Such objections shall be submitted within two weeks from today. It is needless to say that the submissions of the 3rd and 4th respondents shall also be taken into consideration. No costs.
