PRAYER : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorari, calling for the records pertaining to the Impugned Order passed by the 1st respondent in his proceedings in Na.Ka,No.2737/2024/A2, dated 23.10.2024 and quash the same as illegal.

ORDER

The present writ petition has been filed seeking to quash the order passed by the first respondent herein dated 23.10.2024.

2. It could be seen from the records that the petitioner is the daughter of the third respondent. The third respondent has approached the first respondent seeking to cancel the settlement deed executed by 2/6

him on 23.01.2009 in Document No.162 of 2009 on the file of the Sub Registrar, Uthamapalayam under the Maintenance and Welfare of Parents and Senior Citizens Act, 2007. In the said application, the writ petitioner was arrayed as fifth respondent. Her other sisters were arrayed as respondents 1 to 4.

3. A perusal of the order reveals that no notice was issued to the fifth respondent in view of the fact that her place of residence could not be identified. Thereafter, the first respondent has proceeded to pass an order cancelling the settlement deed. Challenging the same, the present writ petition has been filed.

4. The learned counsel appearing for the petitioner submitted that without issuing any notice to her, the present impugned order has been passed.

5. The learned Special Government Pleader appearing for the first respondent was directed to verify whether any notice was issued to 3/6

the writ petitioner herein before passing of the impugned order. On verification, she submits that no notice was issued to the petitioner before passing the impugned order.

6. In view of the above said facts, the order impugned in the writ petition is set aside. The matter is remitted back to the file of the first respondent herein. The first respondent is directed to issue notice to the writ petitioner and other interested persons and after hearing their submissions, shall pass orders on merits and in accordance with law. The Writ Petition stands allowed. No costs. Consequently, connected miscellaneous petitions are closed.
