PRAYER :-Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus directing the 2nd respondent herein to issue the patta to the petitioner with regard to Property in Survey No. 1349/9, 1365/3, 1366/2, 1397/3, 1397/4, 1398/1, 1398/2, 1398/4, 1398/5, 1398/6 and 405/1 situated at Kudalur Village, Gujiliamparai Taluk, Dindigul District based on his representation dated 04.09.2023.

O R D E R

This writ petition has been filed seeking a direction to the 2nd respondent herein to issue the patta to the petitioner with regard to Property in Survey No. 1349/9, 1365/3, 1366/2, 1397/3, 1397/4, 1398/1, 1398/2, 1398/4, 1398/5, 1398/6 and 405/1 situated at Kudalur Village, Gujiliamparai Taluk, Dindigul District based on his representation dated 04.09.2023

2. Heard the learned counsel for the petitioner and the learned Special Government Pleader appearing for the official respondents. 2/5

3. The petitioner submitted a representation to the 2nd respondent on 04.09.2023 seeking patta. However, no action has been taken on the said representation. Hence, the present writ petition has been filed.

4. Learned Special Government Pleader, appearing for the official respondents, submits that the representation of the petitioner's would be considered by the 2nd respondent within a time stipulated by this Court.

5. In view of the above submissions, without expressing any opinion on the merits of the matter, this writ petition is disposed of with a direction to the 2nd respondent to consider the petitioner's representation dated 04.09.2023 on merits and in accordance with law, and pass appropriate orders, after hearing all the interested parties, within a period of twelve weeks from the date of receipt of a copy of this order. Needless to say, if there are any rival claims, the same shall be subject to the jurisdiction of the civil Court. There shall be no order as to costs.
