ORDER

This Writ Petition is filed to issue a Writ of Mandamus directing the respondents to provide the petitioner compassionate appointment in any suitable post for the reason petitioners father died in harness in middle of his services within the time frame.

2. The complaint made by the writ petitioner is that even though the petitioner's father had died on 02.01.2008 and his mother had made an application for compassionate appointment, compassionate appointment had been given to two other individuals whose father who was a Government servant had died after the date of death of the petitioner's father.

3. Learned Special Government Pleader on instructions would submit that the petitioner's mother had originally given a request for compassionate appointment and after the petitioner had attained the age 2/4

of majority that is on 12.04.2012, the petitioner had also made an application and therefore her application is subsequent to the application of the claimants in the other cases and based on the date of application, the petitioner's application would be taken up in the next consideration, for the vacancy that will arise as per the seniority maintained in the office of the second respondent.

4. In view of the above submission, the second respondent is directed to consider the name of the petitioner for compassionate appointment in the next available / suitable vacancy. All such exercise shall be completed as expeditiously as possible.

5. With the above direction, this Writ Petition is disposed of. No costs.
