O R D E R

The present review application has been filed seeking review of the order passed by this Court on 21.07.2025 in W.P.(MD) No.30234 of 2024.

2. The above writ petition was filed challenging the order passed by the fifth respondent, wherein the request of the petitioners for exercising joint 4/8

option under paragraph 11(3) of the Employees Pension Scheme, 1995 was rejected.

3. This Court, after considering the records, has arrived at a factual finding that the petitioners therein had retired prior to 01.09.2014 and they have not exercised their option under the unamended paragraph of 11(3) of the Scheme and in such circumstances, relying upon the judgment reported in 2023 (12) SCC 701, this Court has dismissed the writ petition.

4. The present review application has been filed contending that the petitioners had exercised their option prior to the enhancement of pension and they have retired prior to the amendment in the year 2014. Despite several adjournments, the petitioners are not in a position to provide any records to establish the fact that they have exercised their option under paragraph 11(3) of the Scheme.

5. The learned counsel for all these managements also submitted that they have not received any such request from the concerned petitioners. 5/8

6. In such circumstances, there are no reasons to entertain the present review application. Hence, this Review Application stands dismissed. No costs.
