ORDER
(Order of the Court was made by DR.ANITA SUMANTH, J.) There has been an elaborate hearing, at the end of which, Mr.Shanmuganathan, learned counsel for petitioner, accedes to the suggestion of the Court that the petitioner should approach the appellate authority in terms of Section 79 of the Tamil Nadu Town and Country Planning Act, 1971 ('Act') and file an appeal. 2.Hence, this Writ Petition is dismissed as withdrawn granting liberty to the petitioner to file an appeal under Section 79(1) of the Act and an application for interim protection under Section 79(5) of the Act. 3.If the appeal and stay application are filed within a period of two weeks from today, the same shall be taken on file without reference to limitation but ensuring compliance with all other statutory requirements.
4.As far as interim protection is concerned, the appellate authority will take the stay application up for disposal and pass orders in 2/4
accordance with law, after hearing the petitioner, within a period of four weeks from the date of institution of the stay petition. 5.Status quo as on date, shall be maintained for a period of six weeks from today or till disposal of the stay application, whichever is earlier. Needless to say if liberty as granted above is not availed, the impugned order revives, at the risk of the petitioner, and all consequence shall follow. No costs. Consequently, connected Miscellaneous Petitions are closed.
