PETITION FOR BAIL Under Sec.483 of BNSS PRAYER :- To grant bail to this petitioner in connection with S.C.No.118 of 2014 pending trial before the learned Principal Sessions Judge, Sivagangai in the crime no.333 of 2000 on the file of the respondent police and thus render justice.

ORDER : The Court made the following order :- The petitioner, who was arrested and remanded to judicial custody on 23.09.2024 for the offences punishable under Sections 147, 148, 324, 307, 506(ii) and 302 of IPC, in Crime No.333 of 2000 in S.C.No.118 of 2014 pending trial before the learned Principal Sessions Judge, Sivagangai, seeks bail.

The case of the prosecution is that one Paneer Selvam, President of Udakulam Panchayat, had allegedly misappropriated Panchayat funds, which was brought to the notice of the authorities by the deceased. On that motive, Paneer Selvam, along with the petitioner and other accused, allegedly attacked the deceased and caused his death. Hence, the complaint.

3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has not committed any offences as alleged by the prosecution. He further submitted that the some of the accused were acquitted and that the petitioner is in judicial custody from 23.09.2024. Hence, he seeks bail to the petitioner.

4. The learned Additional Public Prosecutor submitted that the offence committed by the accused are serious in nature. Therefore, he opposed for grant of bail to the petitioner.

5. It is seen from the records that there are nine accused in total. There was a split up trial, A-3, 5, 7 and 8 were acquitted in the original trial. The specific overt act against the petitioner is that he attacked the deceased with a wooden log. Considering the fact that there is no previous case pending against the petitioner and also considering the period of incarceration suffered by the petitioner, this Court is inclined to grant bail to the petitioner, subject to the following conditions: 3/6

Accordingly, the petitioner is ordered to be released on bail on executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties, each for a like sum to the satisfaction of the learned Principal Sessions Judge, Sivagangai and on further conditions that :- [a] the petitioner and the sureties shall affix their photographs and left thumb impression in the surety bond and the Magistrate may obtain a copy of their Aadhaar card or bank pass book to ensure their identity. [b] the petitioner shall report before the Trial Court police daily at 10.30 a.m. until further orders. The petitioner shall not leave Peralam, Thanjavur, without prior permission from the prosecution, and he shall attend the trial on all hearing dates without fail. The petitioner shall not intimidate or threaten the witnesses in the pending trial which pending under Section 302. [c] the petitioner shall not tamper with the evidence or witness either during investigation or trial. [d] the petitioner shall not abscond either during investigation or trial.

[e] On breach of any of the aforesaid conditions, the 4/6

learned Magistrate/Trial Court is entitled to take appropriate action against the petitioner in accordance with law as if the conditions have been imposed and the petitioner is released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)AIR SCW 5560].

[f] If the accused thereafter absconds, a fresh FIR can be registered under Section 269 BNS.
