O R D E R

This writ petitioner filed this Writ Petition seeking for issuance of a Writ of Mandamus, directing the respondents to grant permission and protection for Bajanai Pattapishegam Festival scheduled to be held from 17.12.2023 to 19.12.2023 at Arulmighu Ramar Thirukovil Cheruppancodu, Karankadu, Kanyakumari District, and also permit to arrange Temporary Electric Light and Alangara Valaivu (Decorative Arch) and Panthal is to be perform border of their Cheruppancodu Village.

2. Mr.R.M.Anbunithi, learned Additional Public Prosecutor takes notice for the respondents. By consent, this writ petition is taken up for final disposal at the admission stage itself. 2/5

3. There is no objection by the learned Additional Public Prosecutor to conduct Patabhishegam festival from 17.12.2023 to 19.12.2023. But, with regard to erection of arch, he would submit that it is completely within the power of concerned authority.

4. There is no question of granting permission by the second respondent herein. The petitioner can approach the concerned authority and after getting the order only, he can put up the arch. The concerned authority shall strictly follow the provisions of Tamil Nadu Open Places (Prevention of Disfigurement) Act, at that time of considering the petitioner's representation.

5. With the above direction, this Writ Petition stands disposed of. No cost.
