ORDER

This criminal original petition has been filed seeking direction to the 2nd respondent police to take appropriate action to register a FIR as direction given the learned Judicial Magistrate No.II, Ramanathapuram, dated 04.07.2022, in Cr M.P No. 849 of 2021 within a time frame as fixed by this court.

2.The grievance of the petitioner is that even though order passed by the learned Judicial Magistrate No.II, Ramanathapuram, in Crl.M.P.No.849 of 2021, directing the respondent to enquire and file report, it was not completed.

3.The learned Additional Public Prosecutor would submit that on the basis of the order passed by the learned Judicial Magistrate, enquiry 2/5

was undertaken. During the course of enquiry, it was found that in respect of the very same complaint a suit in O.S.No.164 of 2017 is pending before the Sub Court, Mudukulathur. Hence, the parties were advised to workout their remedy in the pending suit. With the above said advise, the complaint was closed.

4.Let a copy of the closure report be served upon the petitioner. If the petitioner is aggrieved with the same, he can workout his remedy through appropriate proceedings.

5.With the above said directions, this criminal original petition stands disposed of.
