PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the respondents No.3 and 4 to complete the departmental proceedings in Memo No.017629/ 1366/Ni.P.P/P.1/Co.O.Na/2019 and pass final order so as to provide all retirement benefits to the petitioner (Not allowed to retire on 31.05.2022) as per the Electricity Board Proceedings Ms(Ch) No.142, dated 13.04.1987 and as per G.O.Ms.No.81 (Human Resources Management (N) Department, dated 04.08.2022 within the time stipulated by this Court. O R D E R

The present writ petition has been filed by an Assistant Engineer of Tamil Nadu Electricity Board seeking a mandamus as against the respondents for expeditious completion of the departmental proceedings.

2. According to the learned counsel appearing for the petitioner, the petitioner was issued with a Charge Memo on 22.05.2019 and he was not permitted to retire on 31.05.2022. The enquiry proceedings have been completed and report has been submitted to the disciplinary authority on 2/5

03.05.2023. As on today, the enquiry report is pending before the second respondent for passing final orders.

3. Heard the learned counsel appearing for the petitioner and the learned Standing Counsel appearing for the respondents.

4. Considering the above said facts, the second respondent herein is directed to pass final orders on or before 22.01.2024. Based upon the said orders, consequential orders if any, have to be passed, the same shall be passed by the respondents 3 and 4 herein within a period of four weeks thereafter.

5. With the above said observations, this Writ Petition stands disposed of. There shall be no order as to costs.
