PRAYER : Criminal Original Petition filed under Section 482 of the Criminal Procedure Code, to direct the 2nd respondent not to harass the petitioner under the guise of enquiry on the basis of the petitioner's representation dated 15.11.2023.

ORDER

This criminal original petition has been filed seeking direction to the 2nd respondent not to harass the petitioner under the guise of enquiry on the basis of the petitioner's representation dated 15.11.2023. 2.The learned Additional Public Prosecutor would submit that on the basis of the order passed by the learned Judicial Magistrate, Tirunelveli, enquiry is pending. Summon was issued to the petitioner. But, he appeared for enquiry only once. Later, he refused to appear for enquiry.

3.The learned counsel for the petitioner would submit that even though he appeared twice before the respondent and produced the documents, they insisting upon the petitioner to settle the issue. 4.It is the case of the defacto complainant that by creating some false revenue records, this petitioner alleged to have sold the property to some other third party. The above said patta was cancelled by the Revenue Divisional Officer, by the order, dated 26.05.2023. Thereafter, 2/5

the present complaint has been given.

5.Let the said complaint be enquired by the respondent police within a period of fifteen days from the date of receipt of a copy of this order and file the report before the concerned Court. The petitioner must co-operate with the respondent police to complete the above said enquiry.

6.The learned counsel for the third respondent submitted that the complainant approached the Registration Authorities for cancelling the document, that was not considered. If it so, let all the documents be produced before the respondent herein for consideration. 7.With the above said directions, this petition stands disposed of. 11.12.2023 NCC :
