India, praying this Court to issue a Writ of Mandamus to direct the third respondent to consider the petitioner's petition dated 09.07.2025 and issue patta to the petitioner an extent of 1.5 cents in Natham New Survey No.301/1 in Old Natham Survey No.90/3 in Jakkammalpatti, situated in Rajadhani Village, Aundipatti Taluk, Theni District. O R D E R

The petitioner asserts title in respect of 1.5 cents in Natham new survey No.301/1 in Jakkammalpatti. After applying for financial assistance to construct a house on the said land under the Kalaingar Kanavu Illam Scheme, the petitioner was informed that patta is necessary for release of funds. After submitting a representation requesting for a patta, the present Writ Petition has been filed.

learned Government Advocate accepts notice on behalf of the second respondent. Learned Government Advocate has placed on record a Circular dated 27.08.2024 of the Commissioner of Land Administration, Chennai. He points out that the petitioner's land is a Natham vacant site and that the authority to grant a patta is the Commissioner of Land Administration.

3. The revenue records classified the land in survey number 301/1 as 'Natham' and 'Theeruvum Kali idamum'. Therefore, it appears that it falls within category III of the above mentioned circular. The circular provides that a proposal shall be sent by the jurisdictional District Revenue Officer to the Commissioner of Land Administration for taking appropriate decisions in such matters. Therefore, it is just and necessary to implead the Commissioner of Land Administration, Chepauk, Chennai and the District Revenue Officer, Theni, as parties in this Writ Petition. They are suo motu mpleaded as the fourth and fifth respondents. The order shall be issued after carrying out the amendment in this petition.

4. For reasons set out above, this Writ Petition is disposed of on 3/5

the following terms:

i. The District Revenue Officer is directed to consider the petitioner's request for patta and send a proposal in relation thereto to the Commissioner of Land Administration. This shall be done within two (2) months from the date of receipt of a copy of this order. ii. Within three (3) months from the date of receipt of such proposal, the Commissioner of Land Administration is directed to take a decision and communicate the same to the petitioner. iii. No costs.
