PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of MANDAMUS directing the 1st respondent to issue patta and FMB to the Petitioner's property in S.No.M1.24/3 situated in M Block 1, Jinnah Street, Udhayachi group of Devakottai Town, Sivagangai District, measuring an extent of 1738 Sq.Ft by removing the erroneous entry of "Poosthuthi Pathai" in Town Survey Land Register by considering the petitioner's representation dated 12.12.2022 and 18.02.2025 pending on the file of the 1st respondent within a stipulated time fixed by this court.

ORDER

The petitioner asserts title over 1738 sq.ft. in S.No.M1.24/3 by tracing title through his father late A.Mohammad Aliyar. According to the petitioner, the extent of the property is wrongly mentioned in the Town Survey Land Register as 48 sq.metres. instead of 1738 sq.ft. It is further stated that the recording in the remarks column that it is Poosthuthi Pathai is incorrect. After submitting a representation dated 30.09.2020, the petitioner's father did not receive a proper response. Therefore, after submitting multiple representations after the demise of the petitioner's father, the present writ petition has been filed.

2.Learned Government Advocate accepts notice on behalf of all the respondents. He submits that orders would be issued within three months from the date of receipt of a copy of this order.

3.Accordingly, without making any observations on the merits, this writ petition is disposed of by directing the respondents 1 to 3 to conduct an inquiry and issue orders on merits on the petitioner's representation within three months from the date of receipt of a copy of this order after providing a reasonable opportunity to the petitioner. No costs.
