O R D E R

This writ petition has been filed seeking issuance of a writ of mandamus, directing the respondent to consider the petitioner's representation dated 23.09.2025 and consequently, to direct the respondents 2 and 3 to survey and mark the boundaries of land in survey Nos.50/1C, 3B11, 3B13 and 3B6 situated at Sindhupati Village, Usilampatti Taluk, Madurai District.

2. Heard the learned counsel for the parties and perused the materials available on record.

3. The case of the petitioner is that the subject properties are joint family properties. Based on an unregistered partition agreement dated 07.09.1997, her husband obtained Patta No. 1472 for the properties mentioned in the petition. Her husband died on 07.04.2007, leaving the petitioner and two children as his legal heirs. Pursuant to an application made by the petitioner on 17.08.2025 seeking survey, one of the brothers of her late husband raised objections and, therefore, the survey could not 2/5

be conducted. Thereafter, the petitioner submitted a representation dated 23.09.2025 to the respondents requesting survey. Since no action has been taken on the said representation, the petitioner has filed the present writ petition.

4. The learned Additional Government Pleader appearing for the respondents 1 to 3 submits that after considering the claims of all parties, proper steps would be taken to survey and demarcate the land in accordance with Sections 9 and 10 of the Tamil Nadu Land Survey and Boundaries Act, 1923.

In view of the above, this Court directs the second respondent to consider and dispose of the petitioner's representation dated 23.09.2025 for survey and demarcation on merits and in accordance with law. The Tahsildar shall also issue notice to the petitioner, the fourth respondent and to all other persons who may be interested in the subject land, afford them an opportunity to place their objections, record such objections and thereafter pass a reasoned order on merits and in accordance with law. Such exercise shall be completed within a period of twelve weeks from the date of receipt of a copy of this order. In the event of any rival claims, 3/5
