ORDER

This petition has been filed to quash the impugned FIR in Crime No.89 of 2025, dated 21.06.2025 on the file of the 1st respondent Police, registered for the offences punishable under Section 296(b), 118(1) and 351(3) of BNS, 2023.

2. The allegations in the impugned FIR is that on account of prior enmity, the petitioner and the other accused had abused the defacto complainant in filthy language, attacked him with knife and threatened him of dire consequences and thus committed the aforesaid offences.

3. The learned counsel for the petitioner would submit that the petitioner was not present in the scene of occurrence and to prove the same, he has produced a lab report to show that there was a medical examination on the petitioner on the date of occurrence.

4. The learned Government Advocate (Crl.Side) would submit that based on the investigation, the first respondent has filed a final report before the concerned Court.

5. This Court is of the view that the question as to whether the petitioner was present at the scene of occurrence, cannot be adjudicated in the quash petition. That apart, the final report has also been filed before the concerned Court. Hence, this Court is not inclined to quash the FIR in Crime No.89 of 2025, dated 21.06.2025. It is open to the petition to raise all the points before the trial Court.

6. With the above said liberty, this Criminal Original Petition is dismissed. Consequently, connected Miscellaneous Petition is closed. 27.10.2025 NCC : Yes / No Index : Yes / No Internet : Yes/ No Indu To 1.The Inspector of Police, Appanthirupathy Police Station, Madurai District.
