Heard both sides.

2.The respondents issued tender notification for the supply of "Raw materials for the production of mictronutrient mixtures and printed polyester covers for packing". The petitioner submitted his tender notification in response thereto. The petitioner was interested in supplying one item alone, namely, 1000 metric tons of Gypsum. The petitioner's tender was rejected at the technical scrutiny stage itself for two reasons. While there is some controversy as regards the correctness of the first ground, the petitioner's tender has to be rejected for the second reason. One of the tender conditions is that even the distributor can participate but then he must upload the agreement executed with the principal company with reference to the notification in question. The petitioner has enclosed an earlier agreement. The petitioner did not enclose the agreement as

contemplated in the tender notification. Without going into the correctness of the first ground of rejection, on the second ground of rejection, the impugned tender report is sustained.

3.This writ petition stands dismissed. There shall be no order as to costs.
