PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus directing the 1st and 2nd respondent to survey the petitioner's land in Survey No.483/8A5 situated at Reediyapatti, Natham, Dindigul District respectively and fix its boundaries as per the revenue records with the aid of the 3rd respondent police by considering his representation dated 04.09.2025 within the time limit that may be stipulated by this court. 1/4

ORDER
By relying on settlement deed dated 29.09.2020 and patta No.3565 in respect of land in S.No.483/8A5, the petitioner had applied for a survey of the said land. The present writ petition relates thereto.
2. On instructions, learned counsel for the petitioner confirms that there is no rival title claim. He, however, states that persons in occupation of neighbouring lands have attempted to illegally enter upon the petitioner's land. He also states that an FIR has been registered in relation thereto.
3. Learned Government Advocate accepts notice for respondents 1 and 2 and learned Government Advocate(crl.side) accepts notice for the 3rd respondent. Learned Government Advocate submits that only a CSR has been registered and not an FIR. He also submits that action would be initiated on the petitioner's application after issuing notice to owners of relevant adjoining lands.

4.The learned counsel for the petitioner has placed on record title and revenue records relating to the property. It is also asserted that there is no rival title claim and that the only issue relates to attempts by persons in the vicinity to encroach upon the land. In these circumstances, a case is made out for the respondents to act on the petitioner's application. 5.Accordingly, this writ petition is disposed of by directing the first and second respondents to initiate action on the petitioner's application for survey after issuing notice to owners of relevant adjacent lands and considering objections, if any, from them. The entire process shall be concluded within three months from the date of receipt of a copy of this order. If necessary, the revenue officials may take the assistance of jurisdictional police.
