PRAYER :- For Bail in Crime No.219/2023 on the file of the respondent police. ORDER : The Court made the following order :- The petitioners, who were arrested and remanded to judicial custody on 14.10.2023 for the alleged offence punishable under Sections 302 IPC @ 302, 147, 148, 323, 324 and 201 of IPC @ 147, 148, 323, 324, 302, 201, 109 of IPC in Crime No.219 of 2023, on the file of the respondent police, seek bail. 2.The case of the prosecution is that the defacto complainant is the mother of 1/3

the deceased. On 12.10.2023, the defacto complainant after returning from her work found that her son was missing. On searching in all places, she was not bale to find him. On 13.10.2023, she was informed that her son was lying dead under the Mannur by-pass road bridge. Hence the case.

3.The learned counsel appearing for the petitioners would contend that the petitioners are innocent and they have not committed any offence as alleged by the prosecution. He would further submit that the petitioners are in custody from 14.10.2023, hence, he seeks bail.

4.The learned Additional Public Prosecutor appearing for the respondent Police would submit that now, the case has been altered into ST/ST Act. Hence, he strongly objected to grant bail to the petitioners.

5. Considering the submission made by the learned Additional Public Prosecutor, this Court is not inclined to grand bail to the petitioners. 6.Accordingly, this Criminal Original Petition is dismissed with liberty to the petitioners to work out their remedy in accordance with law. sd/- 11/12/2023 / TRUE COPY / /01/2024 Sub-Assistant Registrar ( C.S.
