PRAYER :- Writ Petition, filed under Article 226 of the Constitution of India, praying this court to issue a Writ of Certiorarified Mandamus to call for the records relating to the impugned P.S.T. rejection Slip issued by the third respondent dated 26.8.2025 and quash the same and consequently directing the third respondent to review / re conduct the Physically Efficiency Test /Physical Standard Test and select the petitioner's candidature without reference to the above alleged defect for the post of Police Constable -Constable -Central Reserve Police - General Duty within the time stipulated by this Court. ORDER

The Writ Petition is filed to call for the records relating to the impugned P.S.T. rejection Slip issued by the third respondent dated 26.08.2025 and quash the same and consequently to direct the third respondent to review / re-conduct the Physically Efficiency Test /Physical Standard Test and select the petitioner's candidature without reference to the above alleged defect for the post of Police Constable -Constable -Central Reserve Police - General Duty. 2/6

2. The dispute that has arisen in the writ petition is with regard to the height of the writ petitioner. The petitioner had applied for recruitment to the post of police constable (General Duty) in the CRPF, in which he was found to be under height. While the minimum required height is 170 cm, the petitioner's height was found to be only 169.6 cm, which is sought to be assisted by relying upon a physical fitness certificate issued to him by the Government Hospital, Sathangulam stating that the petitioner's height is 171 cm.

3. The learned Deputy Solicitor General of India contested the claim of the petitioner, indicating that the height was measured using advanced technology and therefore, there could be no error in the measurement.

4. Hence, this Court, by order dated 24.10.2025, directed the petitioner to appear before this Court.

5. Pursuant to the direction of this Court, the petitioner was present today. This Court summoned to the Doctor attached to the High Court Dispensary and requested her to measure the petitioner's height manually. In Court, she measured the height of the petitioner and informed the Court that the petitioner's height is 171.8 cm. When this Court queried as to how such a difference could arise, she suggested that a Stadiometer available in the dispensary, would give the accurate measurement. Hence, the petitioner was directed to accompany the Doctor to the dispensary attached to this Court and she thereafter, reported that the petitioner's height as per the Stadiometer measurement was 170.4 cm.

In view of the above, this Court is of the view that the measurement that has been taken during the physical verification by the respondents would not be entirely accurate, as it is not in dispute that such measurements taken would have difference of 0.5 cm. Hence, in view of the factual verification made by this Court, this Court is of the view that the petitioner has the height to fulfill the height criteria and therefore, he is entitled to be further considered in the selection process. 4/6

In such view of the matter, this Writ petition is disposed of with a direction to the respondents to consider the candidature of the petitioner and if the petitioner is otherwise found eligible, he can be permitted to participate in the further recruitment process.
