O R D E R

This Writ Petition is filed in the nature of Writ of Mandamus directing the respondents 1 to 6 take appropriate action on the basis of the representation given by the petitioner dated 18.10.2023.

2. The facts in brief is that the petitioner is a practicing advocate in Karur. Along with his wife, on 15.10.2023, he went to Uchipillayar Temple, Trichy. After that they went to go to Samayapuram. They rented a room n Sri Maruthi Hotel near Samayapuram area. At about 2.45 p.m,., when he was sleeping, some uniformed women police along with the 2/5

seventh respondent attached to Samayapuram police station, trespassed into the room and enquired their whereabouts. The petitioner informed and gave information about his profession and the relationship between himself and his wife. But without understanding the same, they were harassed, abused. Because of the unruling behaviour of the respondent, they become upset. Over the above said occurrence, he made a complaint to the higher authority to take appropriate action against the seventh respondent and others. Since no action has been taken on his complaint, this present petition came to be filed.

3. Learned Additional Public Prosecutor submitted that on the basis of the search, in the lodge called Maruthi Lodge, a case in Crime No.324 of 2023 was registered against four persons under Sections 3(1), 3(2)(a), 3(2)(b), 4(1) of Immoral Traffic (Prevention) Act, 1956. Except the search, no harassment was made to the petitioner. This petitioner is not arrayed as an accused in this case.

4. If any harassment was made to the petitioner and his wife by the respondent herein, as stated in the complaint, let the complaint be enquired by the fourth respondent herein and dispose of the same. If the 3/5

fourth respondent find anything during the course of enquiry, then he may be proceed departmentally against the petitioner. No criminal intention or activity is involved.
