Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorarified Mandamus, to call for the records on the file of the 1st respondent in connection with the impugned enquiry notice issued by him vide his proceedings in Na.Ka.No.11339/2023/A1 dated 27.11.2023 and quash the same as illegal, arbitrary and consequently direct the respondents not to disturb his lease hold property situated in Survey No.R.S.No.32/2, 0.44 cent Nanjai and Survey No. R.S.No.87/12, 0.05 cent Nanja land at Vilandhakandam Village, Kumbakonam Taluk, Thanjavur District. Heard the learned counsel for the petitioner and the learned Special Government Pleader for first respondent and issuance of notice to the second respondent is dispensed with. 2/5

2. All that has been issued by the first respondent is mere a notice. At this stage, the petitioner's right has not at all been affected. If any adverse order having implication on the petitioner's right is passed, it is open to the petitioner to move this Court at that stage. The petitioner has prematurely come before this Court. Leaving open all the contentions of the petitioners, the Writ Petition is dismissed. No costs. Consequently, connected miscellaneous petition is closed.
